THỎA THUẬN NGƯỜI DÙNG - IFP
I. ĐỊNH NGHĨA:
1. Người dùng: là người đang đổi thiết bị hiện có của mình để lấy sản phẩm mới của Apple.
2. Nhà cung cấp/iFP: nghĩa là CÔNG TY TNHH IFP GREEN TECHNOLOGY VN hoặc CÔNG TY TNHH IFP GREEN TECHNOLOGY VN.
II. ĐIỀU KHOẢN
Chương trình thu cũ đổi mới của Apple bao gồm các điều khoản và điều kiện sau:
Người dùng đổi thiết bị hiện tại của mình lấy sản phẩm mới của Apple sẽ phải tuân theo các điều khoản & điều kiện sau.
Chương trình thu cũ đổi mới của Apple là một dịch vụ được cung cấp bởi các nhà cung cấp dịch vụ trao đổi bên thứ ba của Apple.
Bằng cách chấp nhận giao dịch trong các điều khoản và điều kiện có nghĩa là người dùng hiểu và đồng ý như sau:
1. Người dùng từ đủ 18 tuổi trở lên và có quyền sở hữu hợp pháp đối với máy cũ đổi mới.
2. Người dùng đang truy cập trang web từ [Việt Nam].
3. Dịch vụ trao đổi này được cung cấp bởi nhà cung cấp dịch vụ trao đổi bên thứ ba của Apple (tên: [IFP GREEN TECHNOLOGY VN LIMITED hoặc CÔNG TY TNHH IFP GREEN TECHNOLOGY VN]) ("iFP").
4. Thiết bị trao đổi phải thuộc quyền sở hữu hợp pháp của người sử dụng và không bị cầm giữ, thế chấp, cầm cố hoặc là đối tượng của các biện pháp bảo đảm khác.
5. Người dùng tuyên bố thêm rằng thiết bị trao đổi sở hữu không phải là hàng giả, bị đánh cắp hoặc lừa đảo.
6. Khi giao dịch này hoàn tất, quyền sở hữu thiết bị trao đổi của người dùng sẽ được chuyển cho nhà cung cấp và người dùng sẽ ủy quyền cho Apple thu giá trị mà người dùng nhận được từ nhà cung cấp.
7. Người dùng chịu trách nhiệm sao lưu và/hoặc xóa dữ liệu trên thiết bị trao đổi. Nhà cung cấp và/hoặc Apple không chịu trách nhiệm về dữ liệu của người dùng.
8. Người dùng đồng ý rằng giao dịch trao đổi và giá trị trao đổi sẽ chịu sự kiểm tra của nhà cung cấp và/hoặc Apple. Nếu kết quả kiểm tra khác với kết quả được mô tả hoặc "Find My iPhone" không bị xóa hoặc iFP và/hoặc Apple không nhận được thiết bị trong vòng 14 ngày kể từ ngày giao dịch đổi máy, nhà cung cấp và/hoặc Apple có thể sửa đổi báo giá ban đầu cho thiết bị đổi trả. Nếu báo giá trao đổi thay đổi, người dùng sẽ được liên hệ để xác nhận việc chấp nhận hoặc từ chối giá đã thay đổi.
9. Thiết bị Trao đổi sẽ không bao gồm bất kỳ thành phần hoặc phụ kiện nào được gắn vào thiết bị. iFP không chịu bất kỳ trách nhiệm nào đối với hư hỏng, mất mát, phục hồi, v.v. của: (i) các bộ phận hoặc phụ kiện đi kèm với thiết bị (bao gồm nhưng không giới hạn ở tai nghe có dây hoặc không dây, dây đeo Apple Watch, bàn phím, chuột, dây cáp, bộ đổi nguồn) , miếng dán màn hình, ốp lưng bảo vệ, chân sim, v.v.) nếu người dùng vô tình hay cố ý gửi cho iFP và/hoặc Apple;
(ii) hộp đóng gói và các vật liệu đóng gói liên quan mà người dùng sử dụng để đóng gói thiết bị trao đổi. Bất kể việc trao đổi có bị hủy hay không, tất cả các thành phần hoặc phụ kiện đi kèm với thiết bị, bao bì, hướng dẫn sử dụng và các phụ kiện trong gói sẽ không được trả lại.
10. Người dùng thừa nhận và đồng ý rằng giao dịch trao đổi là giao dịch cuối cùng.
11. Nếu trong quá trình sắp xếp trả lại thiết bị đổi trả, bên chuyển phát nhanh đã được gửi đi nhiều lần và không trả lại được thiết bị cho người dùng hoặc người dùng từ chối nhận thiết bị đổi trả và người dùng không nhận thiết bị đổi trả trong vòng 60 ngày sau khi iFP và/hoặc Apple trả lại thiết bị đổi trả ban đầu. Nhà cung cấp và/hoặc Apple sẽ xem xét việc người dùng từ bỏ thiết bị trao đổi và người dùng theo đây cấp cho nhà cung cấp quyền xử lý thiết bị trao đổi đã loại bỏ theo bất kỳ cách nào được nhà cung cấp và/hoặc Apple cho là phù hợp trong phạm vi được pháp luật hiện hành cho phép.
12. Nếu nhà cung cấp và/hoặc Apple nhận được bất kỳ thiết bị hoặc thiết bị ngoại vi nào khác (ngoại trừ thiết bị trao đổi), người dùng đồng ý rằng nhà cung cấp và/hoặc Apple sẽ có quyền tái chế thiết bị. Người dùng phải từ bỏ mọi quyền đối với thiết bị, bao gồm yêu cầu trả lại thiết bị hoặc yêu cầu giá trị của thiết bị từ nhà cung cấp và/hoặc Apple.
13. Luật pháp có thể yêu cầu nhà cung cấp và/hoặc Apple cung cấp bất kỳ thông tin cá nhân nào mà người dùng cung cấp trong giao dịch này cho cơ quan thực thi pháp luật. Thông tin được thu thập sẽ được nhà cung cấp xử lý theo chính sách quyền riêng tư của nhà cung cấp được cung cấp trên:

14. Ngoài các yêu cầu nhận dạng, nhà cung cấp cũng sẽ gửi một số chi tiết nhất định (bao gồm nhưng không giới hạn ở Nhận dạng thiết bị di động quốc tế ("IMEI")) của từng thiết bị trao đổi được mua từ nhà cung cấp tới một hoặc nhiều hệ thống dữ liệu của séc cho tài sản bị cáo buộc bị mất hoặc bị đánh cắp. Nếu nhà cung cấp và/hoặc Apple biết về bất kỳ thiết bị trao đổi nào bị mất hoặc bị đánh cắp, nhà cung cấp và/hoặc Apple bảo lưu quyền hủy giao dịch trao đổi và người dùng đồng ý hợp tác với nhà cung cấp và bất kỳ cơ quan nào. do nhà cung cấp yêu cầu.
15. Trong phạm vi được pháp luật cho phép, nhà cung cấp và Apple sẽ không chịu trách nhiệm pháp lý đối với bất kỳ tổn thất đặc biệt, gián tiếp, ngẫu nhiên hoặc gián tiếp nào do dịch vụ trao đổi gây ra.
16. Người dùng đồng ý bồi thường cho nhà cung cấp và Apple đối với mọi khiếu nại đối với bất kỳ iFP và Apple nào trong việc thực hiện các nghĩa vụ theo các điều khoản và điều kiện này thay mặt cho người dùng hoặc việc người dùng vi phạm các điều khoản và điều kiện này.
17. Trong phạm vi được pháp luật hiện hành cho phép, các điều khoản và điều kiện này được điều chỉnh bởi các luật và quy định có liên quan của CỘNG HÒA XÃ HỘI CHỦ NGHĨA VIỆT NAM. Tranh chấp phát sinh từ việc thu cũ đổi mới được hai bên giải quyết thông qua thương lượng; nếu thương lượng không thành, một trong hai bên có thể đệ trình lên tòa án có thẩm quyền nơi nhà cung cấp đặt trụ sở.
18. iFP bảo lưu quyền sửa đổi các điều khoản và điều kiện này theo thời gian mà không cần thông báo trước.
19. Tiếng Việt chỉ mang tính chất tham khảo và quyết định cuối cùng của chúng tôi sẽ dựa trên bản Tiếng Anh.
THE IFP USER AGREEMENT
I. DEFINITIONS:
1. User: means a person who is trading-in his/her existing device for new Apple product.
2. Supplier/iFP: means IFP GREEN TECHNOLOGY VN LIMITED or CÔNG TY TNHH IFP GREEN TECHNOLOGY VN.
II. CLAUSES
Apple Trade-in Program includes the following terms and conditions:
The user who trades in his/her existing device for new Apple product will be subject to the following terms & conditions.
Apple trade-in is a service provided by Apple’s third-party trade-in providers.
By accepting the transaction in the terms and conditions means that the user understands and agrees as follows:
1. The user who is 18 years old or older and has lawful ownership for old-for-new device.
2. The user is visiting the site from [Vietnam].
3. This trade-in service is provided by Apple’s third-party trade-in supplier (name: [IFP GREEN TECHNOLOGY VN LIMITED or CÔNG TY TNHH IFP GREEN TECHNOLOGY VN]) ("iFP").
4. Trade-in device must be under the lawful ownership of the user and not held, mortgaged, pledged or object of other security measures.
5. The user further declares that the trade-in device possessed is not counterfeit, stolen or fraudulent.
6. When this transaction is completed, the ownership of the user's trade-in device is transferred to the supplier, and the user will authorize Apple to collect the value obtained by the user from the supplier.
7. The user is responsible for backing up and/or deleting the data on the trade-in device. The supplier and/or Apple is not responsible for the user's data.
8. The user agrees that the trade-in transaction and trade-in value shall be subject to the supplier and/or Apple’s inspection. If the inspection result is different from what is described, or "Find My iPhone" is not removed, or iFP and/or Apple does not receive the device within 14 days from the date of the trade-in transaction, the supplier and/or Apple may revise the original quotation for the trade-in device. If the trade-in quotation changes, the user will be contacted to confirm the acceptance or rejection of the changed price.
9. Trade-In devices shall not include any components or accessories attached to devices. iFP does not assume any responsibility for the damage, loss, restoration, etc. of: (i) components or accessories attached to devices (including but not limited to wired or wireless headphones, Apple Watch straps, keyboards, mouse, cables, power adapters, screen protectors, protective cases, sim card pin etc.) if the user unintentionally or intentionally sends it to iFP and/or Apple; (ii) the packaging box and related packaging materials used by the user to pack the trade-in device. Regardless of whether the trade-in is cancelled, all components or accessories attached to devices, packaging, user manual and accessories in the package will not be returned.
10. The user acknowledges and agrees that the trade-in transaction is the final transaction.
11. If in the process of arranging the return of trade-in device, the courier has been dispatched many times and failed to return the device to the user, or the user refuses to receive the trade-in device, and the user does not receive the trade-in device within 60 days after iFP and/or Apple returns the original trade-in device. The supplier and/or Apple will consider the user to abandon the trade-in device, and the user hereby grants the supplier the right to dispose of the discarded trade-in device in any manner deemed appropriate by the supplier and/or Apple within the scope permitted by applicable laws.
12. If the supplier and/or Apple receive any other device or peripherals (except for trade-in device), the user agrees that the supplier and/or Apple shall have the right to recycle the device. The user must waive all rights to the device, including requesting the return of the device or requesting the value of the device from the supplier and/or Apple.
13. The law may require the supplier and/or Apple to provide any personal information the user provides in this transaction to law enforcement. The collected information will be processed by the supplier in accordance with the supplier's privacy policy provided on:

14. In addition to the identification requirements, the supplier will also submit certain details (including but not limited to the International Mobile Equipment Identity ("IMEI")) of each trade-in device purchased from the supplier to one or more data systems of the check for allegedly lost or stolen property. If the supplier and/or Apple is aware of any trade-in device that is lost or stolen, the supplier and/or Apple reserves the right to cancel the trade-in transaction, and the user agrees to cooperate with the supplier and any agency requested by the supplier.
15. To the extent permitted by law, the supplier and Apple shall not be liable for any special, indirect, incidental, or indirect losses caused by the trade-in service.
16.The user agrees to indemnify the supplier and Apple for any claims made against any of iFP and Apple in the performance of the obligations under these terms and conditions on behalf of the user or the user’s violation of these terms and conditions.
17. To the extent permitted by applicable laws, these terms and conditions are governed by the relevant laws and regulations of THE SOCIALIST REPUBLIC OF VIETNAM. Disputes arising from the exchange of the old for the new exchange shall be resolved by both parties through negotiation; if the negotiation fails, either party may submit it to the court in the jurisdiction where the supplier is located.
18. iFP reserves the right to modify these terms and conditions from time to time without advance notice.
